BUYING YOUR PLANE IN THE U.S. It`s not just about tax! What you really need to know before you buy.

For anyone thinking of buying an airplane, one of the first things they may seek advice on is tax. Although this is understandable, there are other issues which U.S. buyers need to consider before they tackle the taxation side of things.

We spoke with David Norton, a leading U.S. aviation lawyer who owns and flies his own plane. “If you start with tax, I can almost guarantee that you are going to end up with a structure that the FAA considers to be a commercial operation, and if not done correctly will be viewed as an illegal charter operation,” he comments. Rather, Norton explains, the first question should always be, “Who is going to be the registered owner?” It`s worth knowing that you have to be a U.S. citizen to place title to your aircraft on the U.S. civil registry – and that the definition of who qualifies as a U.S. citizen for this purpose is very tight.

As a psychotherapist I deal with many of them, but the most impressive thing remains that, when that happens, I am in the presence of a TRAUMA that has wreaked havoc in someone’s life.

Regardless of how you want to call it and abbreviate it. If you, like me, watched the movie “American Sniper”, true story about U.S. Navy SEAL Chris Kyle, you may think that stress arising from the experience of traumatic events affects only war veterans or civilians involved in catastrophic accidents, measured according to the intensity of the event. So untrue.

In one of my roles, such as of psychological 1st responder, I have been involved in many situations that we may all agree to call tragic: from debriefing a yacht crew following the sudden death of a young crew member, to helping others to overcome the shock of witnessing a freak accident while manoeuvring, which cost one of their crew body mutilation. Or dealing with the guest who caused the accident whilst driving the wave runner, still unable to sleep and victim of panic attacks. Or the chef walking back to the yacht late at night and falling off the gangplank. And many others, all widely removed from any war related situation or catastrophe.

The Super Yacht Industry is facing its greatest challenge and change as it comes to terms with its public visibility, increasing changes in regulatory authority and a younger generation with differing ethos from the previous generations brought up within the sector.

The industry has always lacked a fully recognised professional body and regulator. Simply make a complaint about an Airline pilot and the answer is instant and definitive. Instant recognition of a pathway of full regulation and accountability. A yacht Captain holds the absolute authority over the Yacht but ask the same question you get a flimsy set of possibilities depending on your circumstances and the area you may be in and your position.

Getting a smart education: Are virtual masterclasses the best way to learn?

“And how is education supposed to make me feel smarter? …Every time I learn something new, it pushes some old stuff out of my brain.” So exclaimed cartoon anti-hero Homer Simpson, before he goes on to elaborate, “Remember when I took that home wine-making course, and I forgot how to drive?”

While it`s true – as many of us can testify – that as time goes on, we have the impression, like Homer, of forgetting more than we learn, the opportunities for acquiring new knowledge and skills have arguably never been greater. The internet and the virtual world, for all their sins, have opened-up a vast world of information and learning. And all of this available at the click of a button.

Continuous professional education is indeed a requirement for many lawyers, accountants and others, who are expected to undergo a certain number of hours training per year in order to carry on practising. Quaynote and other providers can offer attendees the opportunity to acquire their CPD (continuous professional development) or equivalent points via their participation at industry conferences.

Insuring tomorrow`s superyacht

Originally a shipping lawyer, Vincent Huens de Brouwer`s journey to becoming a superyacht insurance broker was not an obvious one. Indeed, his company, Covership, is one of a new breed of market entrants who represent something of a reverse trend in a contracting sector. Vince set up his own yacht insurance brokerage five years ago, a time when others were consolidating, scaling back or pulling out of yacht insurance altogether.

We caught up with Vince to find out more about what, in his opinion, is behind these industry changes and what Owners of the future should expect when they come to insure their yachts. Reflecting on his shift from shipping to yachting, from law to insurance, he explains “What I like about insurance is that you find risk solutions for your clients and you solve their claims, which can be very satisfying.”

With reports of superyacht sales reaching record levels during the pandemic, it got us wondering if Owners looking to sell are taking full advantage of this buoyant market. How do you achieve the best price or quickest sale of your yacht? What should the Owner or their representatives do to prepare the yacht for sale?

To answer these questions and more, Tina Collins and Mike Rouse of West Nautical joined Lorna Titley from Quaynote and shared their insights on the latest trends in superyachts sales and chartering.
